Dies geschah indessen in Form eines beiläuligen Hinweises. Die Autzeichnung der Gewobnheitsrechtsbildung des späteren 12. Jhs. in London machte u.a. Ausnahmen fiir bestimmte Handwerker. bei denen man das Eigentinn eines anderen nicbt pfänden durfte. In einer Aufzeichnung des Gevvohnheitsrechtes der Stadt Ipswich ans dem Jahre 1291 findet sich eine Bestimmung, die ein weiteres derartiges Beispiel fiir die Notwendigkeit darstelll. bei der Abfassimg von Regeln iiber die Vindikation anvertrauten Gutes besondere Riicksicht auf diejenigen Situationen zu nebmen. wo Handwerkern Gut zur Bearbeitung iibergeben worden war. Es heisst dort: »Gap. 47. It is ordered by the said commonalty and forbidden that any of the said town take in gage from poor weavers, or poor women woolcombers, or women spinners, or poor tailors or tailoresses, or poor laundresses, or from other poor wretches, any cut cloth, of wool or linen, or parts of such cloth, or combed wool, white or dyed, or flax, or hemp, or woollen or linen thread, or other kinds of goods (whose ownership is) questionable, and this neither for a money debt, nor for bread, nor for wine, nor for beer, nor for any kind of victuals, inasmuch as one may well suspect that such kinds of goods, thus gaged, are not really the property of the poor people who offer them as gages.
