The world has known four sources of law: legislation53, judicial precedent, juristic opinion, custom. They do not always, or perhaps ever, exist together in the same place at the same time. The Ten Commandments and the Nature of law I * I dedicate this lecture, delivered in February, 2002 at Washington and Lee Law School, to Sally AsKew, friend and colleague. I will sorely miss her when she retires. Utterly reliable, fierce and kind, she is a source of strength. Her aid to me and others is far more than professional. For helpful criticism I am in debt to Peter Appel, Sally AsKew, Leigh Bauer, Randy Beck, Calum Carmichael, Gary Francione, Steven F. Friedell, Jared Klein, Olivia Robinson, Frank Stewart, and Reuven Yaron. 53 In what follows, whenever possible, I will use ‘ruler’ and ‘government’ interchangeably to avoid repetition. For a little more on the sources of law, seeAppendix 1. LECTURE 3 *
