side the formally correct, as determined by its material premisses. In other words, jurisprudence must refrain from the determination of the absolutely true, as the material basis to the conclusions of jurisprudence is the only real and existent source of law, namely positive law. Hägerström’s conclusion is that since jurisprudence should only concern itself with positive law, then its method must be accordingly adapted to its object, and subject itself to reality - to the doctrines of sources and methods. From a material point of view, Hägerström’s critique targets the use of the concepts of law, as defined by jurisprudence.Various concepts of law and incidental theories of law are dealt with on the basis of his philosophy, weighed in the balance, and found wanting. What is particularly damning to the doctrines of modern legal science is that, despite their positivistic theory of jurisprudence, which amounts to their legal mandate, they nevertheless deviate from their own method, thereby transgressing their lawful authority. This occurs, for instance, in constructing and formulating theories and concepts of law that lack support in positive law, such as, for instance, the will-theory of law, natural law theory, illegality (in the autonomous meaning), rights and duties as autonomous legal entities, and so forth. Once the history of jurisprudence and its metaphysics has been outlined, an analysis of the same theme from a Hägerströmian perspective will make a contextualization of the issues at hand possible. Hägerström’s critique of natural law finds its basis, as demonstrated earlier, in his philosophical examination of the fundamentals of metaphysical ideas - a critique that carries over into politics, law, and science. In short, his analysis amounts to the conclusion that the claims of natural law are theoretically untenable. There exists no super-natural system of law, for there exists no parallel reality in which the supernatural system of law can reside.
