The second technique,“Die logische concentration”,264 distills or concentrates the essentials of a rule of law - in other words, the technique according to which a principle of law is generated. And finally, the third technique, “Die juristiche Construction” (conducted by means of “Die höhere Jurisprudenz oder die naturhistorische Methode”)265 analyzes and systematizes “die juristische Körper”, thereby providing the purely scientific description of these categories of law according to: “ … seiner Natur, Beschaffenheit, Bestimmung, seinen Kräften, Eigenschaften, seiner Aehnlichkeit und Verschiedenheit von andern Körpern, den Verbindungen, die er mit ihnen eingehen, oder den Conflicten, in der mit ihnen gerathen kann”.266 All in all, the touchstone of the validity of scientific construction is the new legal rule’s correspondence to the system of law as well as its systematic consistency.267 Jhering’s understanding of law, legal activities, and jurisprudence thus makes him completely logical and consistent when he argues that jurisprudence is productive, and that scientific productivity itself is best conducted under the aegis of the legal system itself, which leaves the field wide open for the truly free scientific production of law.268 In order to achieve this goal, jurisprudence had to become even more scientific than it hitherto had been, and for that reason Jhering and Gerber sought to make jurisprudence less dependent upon non-juridical categories such as history, philosophy, and economics and bring jurisprudence nearer to the natural sciences and their scientifically superior methods of categorization - see, for example, what Jhering writes about “die Rechtskörper” and “die naturhistorische Methode”.What is most telling for the transformation of jurisprudence into “natural science” a ca l l f o r s c i e n t i f i c p u r i t y 627 264 Ibid., pp. 379-384. 265 Ibid., pp. 384-385. 266 Ibid., p. 389.
