gives rise to gaps in the system of law.221In order to avoid and overcome such defects of the law and the study of law Savigny prescribes the application of a uniform method of interpretation, by which means: It is thus the systematic aspect of legal understanding that is stressed. However, the theory of the Historical School demands that the logical, conceptual understanding of law must be tempered by an historical understanding of it.
