should be validated ex analogia; some patently untrue conclusions should be regarded as being fictively true; some conclusions contain unproved premisses that nevertheless are to be presumed as being true until refuted.And so forth. So in conclusion, the text is actually but one of several factors, albeit the most important, that must be taken into consideration in the interpretation and application of a norm. From a philosophical perspective the source of law, the text is the conditio sine qua non for a scientifically objective account of the law. Given the severe strictures that Hägerström and the Uppsala School placed upon scientific reasoning, it would appear to be quite natural to assume that he would disapprove of anything but a logically closed literal and grammatical doctrine of statute interpretation - but appearances are deceptive.According to his legal theory, the foremost tasks of legal science471 were to interpret, comment, and supplement the law for the benefit of the judge.472 It was a task that legal science should perform on the one hand, by acting as a guide to the judge in his application of positive law, and on the other, by increasing the his understanding of the proper meaning of positive law.473 For the common understanding of legal science is (using private law as an example): a ca l l f o r s c i e n t i f i c p u r i t y 527 471 Swedish: rättsvetenskap, German.
