or true facts.92 Hägerström thus suggested that that branch of science that jurists had learned to scorn, philosophy, perhaps could again be of use to the science of law.93 Accordingly, the philosopher now had to approach the halls of justice in more a humble posture than before, and provide jurisprudence with the only tool that he had the authority to provide, namely a philosophical analysis of the concepts. For it was only by means of a consistently applied philosophical analysis of the concepts that philosophy could help jurisprudence to: “… attain a real world of scientific concepts, which must be internally coherent.”94 For it was this incoherence of the legal concepts and principles that was the challenge jurisprudence faced. Conceptual analysis thus became a necessary utility for jurisprudence.95 The conclusion that Hägerström drew from his analysis of the state of the art of jurisprudence thus indicates that jurisprudence had failed to meet the most basic scientific standards.The only way for jurisprudence to avoid to fail was to adopt a critical attitude towards the traditional concepts of law, and on the basis of such a philosophically non-dogmatic perspective to try to rebuild the jurisprudential constructs.Therefore, to Hägerström within the study of law, just as it was within the study of philosophy, it was of paramount importance to conduct a thorough analysis of the scientific concepts in order to reveal their true meaning.The task of philosophy was thus a truly analytical enterprise, not a synthetic attempt to deduce (new) law from the legal concepts themselves, since such an enterprise would constitute a methodological misuse of the analytical nature of the deductive method. a ca l l f o r s c i e n t i f i c p u r i t y 321 92 Hägerström, “Begreppet viljeförklaring,” p. 99; “Declaration of Intention,” p. 299.
